A European Parliamentary Research Service briefing by Anthi Akritidou, published 21 October, finds an "emerging consensus" across jurisdictions that purely AI-generated content with minimal or no human creativity is not protected by copyright, pointing to court decisions in Prague (2023), Frankfurt (December 2025), Munich (February 2026) and Düsseldorf (April 2026); the Munich court allowed protection only where the prompting determines the output so far that it reflects the prompter's personality, and not for picking among AI suggestions or for time spent. The briefing says the AI Act leaves the question open, notes that its labelling duties apply from 2 August 2026, and says the European Commission, which followed a May call for evidence with a targeted consultation on copyright and AI in September, may reopen the Digital Single Market copyright directive or propose a new instrument.
